The Bar Council of India has finally decided to conduct the third All India Bar Examination as per the scheduled date i.e. on January 8, 2012.

On January 2, 2012, two practicing lawyers filed a written petition in the Delhi High Court seeking to scrap the AIBE. These lawyers argued that they were enrolled as Advocates with the Delhi Bar Council in 2011 and undergoing training before several Courts, Tribunals and other authorities.

Further, they cited that the Calcutta High Court has stayed the result of the previous two exams conducted by BCI, as their exams rules 9, 10 and 11 are required to be analyzed by the court. There is no use of conducting the third exam when the results of previous examination had not come out.

The BCI had also announced on July 12, 2010 that all newly enrolled members in the Bar Councils will have to appear for an exam if they want to be enrolled as regular member. This rule has also been challenged in the Supreme Court and a hearing on this issue will be done in February.

Meanwhile, the third AIBE will be conducted as per the scheduled date from 11:30 am to 3:00 pm. Candidates must ensure that they reach the examination centre in advance as entry to the examination centre will not be allowed after 11:15 am.

Candidates will be allowed to carry any books or reference materials (including the preparatory materials). However, they are not permitted to share these materials.
